Agreement.

This website is owned and operated by Coastal Finance Solutions Coastal Finance Solutions Pty Ltd (ABN 15 544 947 329) (“CFS, we, us, our”) and by using this website you (“User”, “Customer” “you” ”your”) agree to be bound by these Terms and Conditions which include our Privacy Policy (“Agreement”). We recommend that you read these terms carefully. These terms and conditions may be amended from time to time at the Owner’s discretion and without prior notice to you so we recommend that you re-visit this page in the future in case changes have been made. These terms govern your use of the website and the services provided by CFS. If you do not agree to be bound by this Agreement then you should not proceed with using this website. If we agree to different terms with you, then those terms will prevail over this Agreement.

Requirements of Use.

The products and services offered on this website are only available to Users over the age of 18 years old who are legally authorised to obtain finance in Australia. If you are accessing and using this website on behalf of someone else, you represent that you have the authority to bind that person as principal to these Terms and Conditions.

Our Services.

CFS provides information about, and assists Customers with tailoring finance packages to suit individual needs. We identify financing options for personal, business, assets and equipment needs.  
We provide general information about the types of finance options that may be available to you. All finance is subject to the decision of the lenders that CFS works with and any loans will be on terms between you and the lender, not CFS. Accordingly, it is important that you understand that:
  • the information on our website and use of our service is not a legally binding agreement about the provision of finance to You; and 
  • we provide general information, CFS does not give financial advice or advice about credit related products in circumstances where we have assessed your personal financial situation.

Third Party Links.

We may at times provide links to third party websites. Once you leave the CFS Website we no longer have control over the information provided to you and you will need to review the terms and conditions and privacy policy of the third party website.

Disclaimer.

We identify Customer’s needs and refer you to a lender on our panel who may have a product offering to suit you. CFS will undertake that referral in accordance with the relevant laws. CFS does not provide financial advice or assistance or offer financial services as defined by the Corporations Act 2001. Nor are we a credit provider or credit assistance provider as defined by the National Consumer Credit Protection Act 2009. As such, CFS does not require an Australian Financial Services Licence (AFSL) an Australian Credit Licence (ACL) nor are we required to be authorised by an AFSL or ACL holder.

Any reference to the word 'advice' should be taken to solely be a reference to general information based upon the information that you give CFS about the type of finance that you are looking for, and does not include consideration of your entire financial circumstances. We recommend that Users obtain independent financial advice from a licensed provider. CFS may receive a commission from a lender if you proceed with a loan because of our referral.  

Images displayed on this website are examples of the type of equipment that may be financed, the images should not be considered as representing equipment that is actually for sale.

Intellectual Property Rights.

CFS retains all ownership rights over all intellectual property (registered or unregistered) available on the website including all content, trademarks and moral rights. The Owner claims copyright over all content on the Website.

License to You.

CFS grants you permission to use the Website through this non-exclusive, non-transferable limited license. CFS has the discretion to terminate your license immediately and without notice if you breach this license and reserve our rights to take action against you. All rights not specifically granted under this Agreement are reserved by the Owner and, as applicable, its licensors.   
This limited license excludes the right to frame or utilize framing techniques to enclose the Website or any portion of it; republish, redistribute, transmit, sell, or license the Website or any content; make any use of the Website or any and/or all content other than for personal use; modify, reverse engineer or create any derivative works based upon the Website or any and/or all content; collect account information for the benefit of yourself or another party; use any meta tags or any other hidden text utilizing any and/or all content; use software robots, spiders, crawlers, or similar data gathering and extraction tools, or take any other action that may impose an unreasonable burden or load on our infrastructure or server; download any image or content and pass it off as your own, or provide it to a third party or republish or distribute it.

Users also agree that you will not use technology or other means that is not authorised by CFS to access to gain or attempt to gain unauthorised access to the Website including the networks or user accounts; or attempt to or engage in conduct that damages, disables, overburdens, or impairs the Website, servers or networks.

Website Functionality.

CFS will take reasonable steps to ensure the ongoing effective operation and maintenance of the website and take steps to repair technical issues that arise from within the App within a reasonable time, insofar as the issues are of a global nature, and do not arise from individual use.

Limited Liability.

Without limiting the operation of the Australian Consumer Law, CFS excludes all conditions, warranties, terms and guarantees otherwise implied by law. Users use the Website at your own risk. To the extent permitted by law, CFS is not liable to pay for any indirect, economic, special or consequential loss or damage including but not limited to loss of revenue, profit, production, business or claims made against it arising from the your use of the Website.

Warranties and Indemnities.

CFS does not warrant that the Website will be uninterrupted or error free or that the Website, its content or the server are free of viruses or other harmful components. CFS does not guarantee against third party interference nor that the Website or its content will be compatible with third party software or hardware. CFS is not liable for any default due to an act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond the CF’s reasonable control.

General.

If any provision of this Agreement is invalid under any law the provision will be deleted from the Agreement and the remaining provisions will remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of Victoria and Australia and the parties agree that any claim arising out of this Agreement will be heard in Victoria.

Severability.

Any provision of this Agreement which is prohibited or unenforceable in any jurisdiction will, as to such jurisdiction, be effective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof or affecting the validity or enforceability in such provision in any other jurisdiction.
